Jailbreaking/Unlocking is LEGAL!!!!!

The US Federal government has decided that “Jailbreaking” is ok!

WASHINGTON – Owners of the iPhone will be able to break electronic locks on their devices in order to download applications that have not been approved by Apple. The government is making that legal under new rules announced Monday.

The decision to allow the practice commonly known as “jailbreaking” is one of a handful of new exemptions from a federal law that prohibits the circumvention of technical measures that control access to copyrighted works. Every three years, the Library of Congress authorizes such exemptions to ensure that existing law does not prevent non-infringing use of copyrighted material.

In addition to the jailbreaking being ok’d it looks like another exemption will allow owners of used cell phones to break access controls on there phones so that they can switch wireless carriers!!!!!

Could this mean that we are finally going to get AT&T to unlock our iphones?

  1. Well that’s awesome!!! But will they make Apple let us restore back to other firmwares that we didn’t get our shsh’s saved? I think that is the next best question

  6. To my understanding unlocking has never been illegal. I’ve been told if you want your phone unlocked you simply go to your carrier and ssk for some unlock code or something. I haven’t verified this as I’ve had no need for an unlocked phone. Jailbreaking on the other hand was in the grey, appearently just jailbreaking was legal. The question then was, was what you’d do with the jailbroken phone legal or not? Fair amout of people would be in the “no” category (installuous anybody)?

  9. Jailbreaking has always been legal. You bought the device, you do with it what you want to. Unlocking has always been legal too, you dont pay $30 a month for the phone, you pay for the service. And how would AT&T know anyways?

  11. Well you pay for the physical phone up front. But you pay the monthly charge for service.

  12. I live in Northern Irrland have owned a pay and go 3GS that I paid £500 for around a year. My phone was jail broken up until today when I updated to Os4 via I tunes, such a mistake. Cydia have my SSHS on file but I’m still behind bars. I’m gutted, I miss Cydia, and Rock, and my clear Blue theme that fellow iPhone owners loved but due to being shit scared of trying to jailbreak never got close to having. I’m not a uneducated neewby that can’t follow instructions, blackrain, and Spirit gave my I phone life, could someone please slip a new key under my cell door before my 3GS and me die in prison.

  13. Try Tiny Umbrella it searches for your shsh file from Cydia. Then run the tss server and shift restore in iTunes with Tiny Umbrella running before iTunes was up and running. This will restore down to 3.1.3 but i don’t know if you can still unlock. I know you can jailbreak.

    yes this blog is true it’s even on yahoo lol and I’m not sure about your other question I’m using the blackra1n for my unlock/jailbreak if you find another one please let me know :)

  16. @ dieonne Well my buddy has his unlocked on 3.1.2 with black rain but his cydia doesn’t want to wrk any more. What can I do to install cydia back. He dnt want to lose his unlock

    Well
    First off the latest firmware is 4.0.1 (last I checked) and second yes Spirit can jailbreak 3.1.3 and through Cydia get the unlock.

    Isn’t it a bit of both? Yes the bill you pay every month allows you to continue using the service, otherwise they’d cut it off. Throughout the two years you’re pretty much paying for the iPhones full $500 price with the “required” $15 miniunm data plan, 15×12=$360 plus the $200 you paid up front equals $560. Look at that, Apple makes a $60 profit on the last four months of our contract. This is how I look at the whole contract thing with phones, I’m probably wrong but whatever.
    Dadude, people shouldn’t only talk when they mow they’re right, what’s the fun in that? Nobody learned anything that way.

  21. I ment 4.0.1. But he not on firmware 3.1.3. And can only update to 4.0.1. Will that be a problem

    I believe the only way to get to 3.1.3 at this point is if you saved your SHSH blobs because you’re right about only being able to update to 4.0.1.

  23. Spirit only jailbreaks 3.1.x, as of now. In a week or so a new one will jailbreak AND (supposedly) unlock all idevices on 4.0 and 4.0.1 (once again supposedly).
